Terms of Service

Please read these Terms carefully before using EcomIntent. By accessing or using the API, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Who We Are

EcomIntent ("we," "us," "our") is a machine learning API service that classifies e-commerce customer support tickets by intent. The service is operated by John Bolognino, based in Massachusetts, United States. For contact information, see Section 14.

These Terms of Service ("Terms") govern your access to and use of the EcomIntent API, website at ecomintent.com, and any related documentation (collectively, the "Service").

2. Eligibility

You must be at least 18 years old and capable of entering a legally binding contract to use this Service. By using EcomIntent, you represent that you meet these requirements. If you are using the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

The Service is available globally. Users outside the United States are responsible for compliance with local laws applicable to their use of the Service.

3. API Access and Account

3.1 API Keys

Access to the EcomIntent API is provided via API keys issued through RapidAPI or directly by EcomIntent. You are responsible for keeping your API key confidential. Do not share your API key publicly or embed it in client-side code. You are responsible for all activity that occurs under your API key.

3.2 Usage Limits

Your API usage is subject to the call limits of your subscription plan. Calls exceeding your plan limit will be subject to overage fees or throttled, depending on your plan configuration. We reserve the right to suspend access for accounts that cause disproportionate load on our infrastructure.

3.3 Free Tier

The Free plan is provided without warranty, service level agreement, or guaranteed uptime. We reserve the right to modify, limit, or discontinue the Free plan at any time with reasonable notice.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

5. Data You Submit

5.1 Your Input Data

You retain all ownership of the text inputs you submit to the API ("Input Data"). By submitting Input Data, you grant EcomIntent a limited, non-exclusive license to process that data solely for the purpose of returning classification results to you.

5.2 Model Training Data (Opt-In)

We may use low-confidence API responses to improve our model accuracy — but only if you explicitly opt in. By default, your Input Data is never stored or used for training. If you choose to opt in via your account settings, we store a hashed (anonymised, non-reversible MD5) version of low-confidence inputs alongside the predicted intent label and confidence score. Raw input text is never stored.

You may opt out at any time by toggling the setting in your account dashboard or by contacting us. You may also request deletion of any stored hashed examples associated with your API key at any time.

5.3 Data Retention

If you have opted into model training data collection, hashed examples are retained for a rolling 12-month period and then deleted. All other API request data is retained only for as long as necessary to deliver the service and comply with legal obligations.

6. Intellectual Property

The EcomIntent model, API, website, documentation, and all associated intellectual property are owned by EcomIntent and are protected by copyright, trade secret, and other applicable laws. Nothing in these Terms grants you any rights in EcomIntent's intellectual property except the limited right to use the Service as described herein.

The trained model weights are proprietary. Where EcomIntent publishes model weights openly (for example, on HuggingFace under Apache 2.0), the terms of that specific license govern use of those weights only. These Terms of Service govern use of the hosted API separately.

7. Billing and Payment

7.1 Subscription Plans

Paid plans are billed monthly or annually, depending on your selection. Billing is processed through RapidAPI or, for direct customers, through Stripe. All prices are in US Dollars unless otherwise stated.

7.2 No Refunds

All payments are non-refundable except where required by applicable law. If you cancel a paid plan, your access continues until the end of the current billing period.

7.3 Price Changes

We may change our pricing at any time. For existing subscribers, price changes take effect at the next billing cycle following 30 days' written notice by email.

7.4 Taxes

You are responsible for any taxes applicable to your use of the Service in your jurisdiction. Where required by law, we or our payment processors may collect and remit applicable taxes.

8. Service Availability and SLA

We aim to maintain high availability but do not guarantee uninterrupted or error-free service. No Service Level Agreement (SLA) is provided on Free or Starter plans. Pro and Enterprise customers may request SLA terms in writing.

We may perform scheduled or emergency maintenance at any time. We will endeavour to provide reasonable advance notice of scheduled downtime.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the API's classification outputs are accurate, complete, or suitable for any specific use case. Model accuracy varies depending on the nature of input text. You are responsible for validating outputs before using them to make automated decisions that affect your customers.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ECOMINTENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) US $50.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless EcomIntent and its operators from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any data you submit to the API.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if required by law. Upon termination, your right to use the Service ceases immediately.

You may terminate your use of the Service at any time by cancelling your subscription and ceasing to use the API.

Sections 5, 6, 9, 10, 11, and 13 survive termination of these Terms.

13. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, with proceedings conducted in English.

Users in the European Union: Nothing in these Terms limits your rights under applicable EU consumer or data protection law, including your rights under the GDPR. If you are an EU consumer, you may also have the right to submit complaints to your local data protection authority.

Users in the United Kingdom: These Terms are governed by Massachusetts law to the extent permitted by UK law. Nothing limits your statutory rights under UK consumer protection legislation.

Users in Australia: Nothing in these Terms excludes, restricts, or modifies rights you have under the Australian Consumer Law that cannot be lawfully excluded.

Class action waiver: You agree to resolve disputes individually and not as part of a class, collective, or representative action.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms at this URL and updating the "Last updated" date above. For paid subscribers, we will also send notice by email at least 14 days before material changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

15. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and EcomIntent regarding the Service.

Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

No waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.

Assignment. You may not assign your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Force majeure. We are not liable for delays or failures in performance resulting from causes beyond our reasonable control.
